London, UK, Feb 05 2010 – Empire Claims, leading UK independent financial recovery firm, says the latest Supreme Court ruling in favour of the banks could well be illegal – and that customers should continue filing claims with them.
Regulated by the Ministry of Justice, the lawyers at Empire Claims have successfully won back millions of pounds in unfair bank, credit card and payment protection charges for its customers. However, the banks recently successfully overturned the OFT’s earlier action – a kick in the teeth for the consumer. It means banks can once more charge excessive fees without fear of investigation. The OFT has been refused leave to appeal, although the rules on credit cards and PPI’s remain unaltered.
However, Empire Claims is already looking into a new legal argument for unfair bank charges – and is urging consumers to keep registering their claims with them. A glimmer of hope was offered by the Lord Chief Justice, who said it had “not closed the door on the OFT’s investigations” – and that they could still try to scrutinise bank charges under other parts of the Consumer Credit Act.
